Oil Tank Removal For A Mortgage In New York

What underwriting is asking for when a buried tank holds up a closing.

What matters before the work starts.

A tank becomes a mortgage problem at the point somebody writes it into a commitment letter as a condition. From then on the deal moves at the speed of the paperwork.

What Underwriting Treats As Unresolved

An unknown buried tank is an environmental unknown attached to the collateral, so it gets conditioned rather than ignored. The condition is normally satisfied by evidence of proper closure rather than by removal specifically.

Read the condition wording carefully. Removal and documented abandonment are not always interchangeable in what a particular lender will accept.

The Disclosure That Started The Conversation

Since March 20, 2024, New York sellers can no longer buy their way out of the Property Condition Disclosure Statement with a credit. Question 21 asks whether there are or have ever been fuel storage tanks above or below the ground on the property, and Questions 25 and 26 cover petroleum releases and testing.

That answer is now in the file in writing on effectively every New York residential sale, which is why tanks surface earlier in transactions than they used to.

Selling With A Tank Still In The Ground

Suffolk County makes it unlawful to sell or transfer land containing an improperly abandoned underground storage facility unless the purchaser has been made fully aware of it. That provision binds tanks that are not exempt from the county's storage rules.

It is the reason a buyer's attorney asks for closure documents rather than a verbal assurance.

Working Backward From A Closing Date

Give us the date first. Permit issue and, where the ground was sampled, laboratory turnaround are the two items that do not compress, and both sit ahead of the document you actually need.

If the date cannot be met we will say so at the quote stage rather than at the end.

Questions On This

Can we close with the tank still there and money held in escrow?

That is a decision for the lender and the attorneys on the deal, and it does happen. Our part is producing the closure evidence, and telling you honestly how long it takes so the parties can decide.

The buyer's inspector found a fill pipe but no tank. What is that?

A fill or vent pipe with no tank behind it is common where a tank was removed years ago without paperwork, and it is exactly what a sweep is for. It can also be a capped line that leads nowhere, which is why nobody should conclude either way without looking.

Does an abandoned tank with old paperwork satisfy a lender?

Sometimes, if the paperwork shows the closure met the standard and the county permitted it where permission was required. Send us what you have and we will tell you whether it stands up before you spend anything.

What The Lender Asked For

You do not need the tank size or the install date. The property address and who is waiting on the paperwork is enough to price the job and set a date.
